This Photographer Agreement & Authorization (“Agreement”) is made and entered into as of the date of acceptance by the undersigned photographer (“Photographer”), by and between PhotoReal LLC (“Company”), a provider of real estate media services, and the Photographer.

1. Scope of Work

The Photographer agrees to provide professional real estate photography services, including but not limited to:

  • Interior and exterior photography
  • Aerial (drone) photography (if applicable and licensed)
  • 3D virtual tours and video walkthroughs
  • Floor plans and other media as requested by clients

2. Photographer Requirements

By signing this Agreement, the Photographer represents and warrants that they:

  • Hold all necessary licenses and certifications, including FAA Part 107 for drone operations (if applicable).
  • Maintain an active Certificate of Insurance (COI) for general liability coverage.
  • Have successfully completed a background check as required by PhotoReal LLC.
  • Own or have access to the necessary professional equipment to meet industry standards.

3. Independent Contractor Status

The Photographer acknowledges that they are operating as an independent contractor and not an employee of PhotoReal LLC. As such:

  • The Photographer is responsible for their own taxes, insurance, and business expenses.
  • PhotoReal LLC is not liable for any injuries, damages, or claims arising from the Photographer’s work.

4. Image Rights & Usage

  • The Photographer grants PhotoReal LLC a non-exclusive, worldwide license to use, distribute, and market all images and media created under this Agreement.
  • The Photographer retains the copyright to their work but agrees that PhotoReal LLC and its clients may use the media without additional compensation.

5. Payment Terms

  • Payment for services will be issued within [X] business days of job completion and approval by the client.
  • Rates and pricing will be determined based on PhotoReal LLC’s standard pricing structure or any agreed-upon custom rates.

 

6. Code of Conduct

The Photographer agrees to maintain a professional demeanor and comply with all client requests within the scope of work. Unprofessional behavior, missed appointments, or failure to meet quality standards may result in termination of this Agreement.

7. Confidentiality & Non-Solicitation

  • The Photographer agrees to keep client and company information confidential.
  • The Photographer shall not directly solicit or accept work from clients introduced through PhotoReal LLC for a period of [X] months following their last project through the platform.

8. Termination

PhotoReal LLC reserves the right to suspend or terminate this Agreement at any time if the Photographer fails to meet professional standards or violates any terms outlined herein.

9. Agreement Acceptance

By signing below, the Photographer acknowledges that they have read, understood, and agreed to the terms of this Agreement.
